Real Estate & Construction

Plot fraud, forged deeds and project disputes — verified before you pay.

Overview

Land is Nepal's most litigated asset: double sales of the same plot, forged deeds (किर्ते), boundary and tenancy fraud, advances swallowed by developers, and contractor billing scams on projects. Almost every dispute traces to a purchase made without Land Revenue Office verification.

Our practice covers both prevention and cure — pre-purchase verification of लाल पुर्जा, survey maps and encumbrances; FIR and trial work for plot and project fraud; and developer-side documentation (बैनाबट्टा, sale deeds, contractor controls) that keeps projects out of criminal court.

Legal framework

The Nepalese laws that govern this area — what each one does in your matter.

Land Act, 2021 (1964) & Land Revenue rules

Ownership transfers only by registered deed at मालपोत; verification of mortgages, injunctions and acquisition notices before any advance.

Unregistered transfers void for ownership

Penal Code forgery & fraud

Forged deeds and fraudulent land sales punished under document-offence and fraud chapters, with victim compensation.

Multi-year terms + compensation

Contractor & billing fraud

False measurements, double billing and material substitution prosecuted as fraud and breach of trust.

Fraud tariff to 7–10 yrs

Banking Offence overlay

Project-loan diversion and cheque chains in developer financing attract banking-offence liability.

1–5 yrs graded + recovery

Consumer Protection Act, 2075

Buyer claims for deficient housing delivery — inspection, correction and compensation routes.

Correction + compensation orders

How we handle it

  1. Verify before money moves

लाल पुर्जा, survey map, मालपोत encumbrance check and litigation search — one visit that prevents years of cases.

  2. Paper the deal

बैनाबट्टा with schedules, penalties and registration-day mechanics; full payment only on registration.

  3. FIR on fraud

Double-sale and forgery complaints with deed, receipt and witness annexures that compel registration.

  4. Trial & recovery

Criminal trial plus civil recovery of advances with interest — and attachment of the disputed asset where available.

  5. Project controls

Developer-side billing verification, contractor blacklisting records and buyer-communication discipline.

Punishments at stake

Land fraud draws multi-year terms plus fines and compensation, forgery its own tariff — while unverified buyers risk losing both the money and the plot, which is why verification is the real remedy.

Common questions

I paid an advance and the seller sold to someone else. What now?

File a criminal complaint for fraud/cheating immediately with your receipts and agreement, and pursue civil recovery in parallel. Speed matters — the plot may be sold a third time.

How do I check a plot before buying?

Match लाल पुर्जा to the seller's citizenship, verify plot number and area on the survey map, and check mortgages, injunctions and pending suits at the Land Revenue Office. Never pay in full before registration day.

A contractor billed for work never done. Is that criminal?

False measurement and billing fraud support criminal complaints for fraud and breach of trust alongside contractual claims — especially with engineer-certified quantity evidence.
